Prórroga de los permisos de conducir británicos- Brexit

Prórroga de la validez de los permisos de conducir británicos en España

El pasado mes de febrero, se publica en el BOE la Orden PCM 122/2022, de 24 de febrero por las que se prorrogan las medidas contenidos en el articulo 15 Del Real Decreto-ley 38/2020, de 29 de diciembre.

En este RD-ley se establecen medidas de adaptación a la situación generada por el Brexit y por tanto, las consecuencias derivadas de la salida de Reino Unido de la UE una vez finalizando el periodo transitorio.

Unas de estas medidas es relativa a la habilitación a los titulares de permisos de conducir británicos a conducir en nuestro país.

Prórroga de los permisos de conducir británicos

A modo resumen, la propia DGT establece en su web oficial, en relación al canje de los permisos de conducir británicos que:

El Reino Unido dejó de pertenecer de forma efectiva a la Unión Europea a partir del 31 de diciembre de 2020, por lo que todos los acuerdos en materia de tráfico en el marco de la UE han dejado de tener validez para los titulares de los permisos de conducir expedidos por el Reino Unido. En concreto:

-Desde el pasado 1 de enero de 2021 los permisos expedidos por las autoridades británicas habilitarán para conducir en España hasta el 30 de abril de 2022, no siendo válidos para conducir en nuestro país a partir de ese momento. Siendo de aplicación a partir de dicha ficha lo indicado en el artículo 21 de normativa general de Conductores.

-Para los titulares de un permiso de conducción británico que hayan solicitado el canje, la sustitución o renovación antes del 31 de diciembre de 2020 podrían tramitarlo siempre que hayan sido verificados por las autoridades del Reino Unido antes del 1 de enero de 2021. 

-Si no se hubiera solicitado el canje entes del 31 de diciembre de 2020, la única opción (a fecha actual) es la de obtener un permiso de conducir en España (desde cero).

En base a lo expuesto, la mayoría de los ciudadanos británicos que no hubieran realizado el canje durante el periodo establecido, y a falta de un convenio bilateral entre ambos estados, han visto sus permisos totalmente inválidos en España.

Convenio bilateral entre España y Reino Unido para el canje de los permisos de conducir

En la actualidad se está negociando un Acuerdo bilateral en materia de tráfico que incluye, entre otras materias, la posibilidad de que los ciudadanos españoles y británicos residentes por más de seis meses en Reino Unido o España, respectivamente, puedan canjear su permiso de conducción por uno británico o español, según corresponda, determinándose asimismo las condiciones en que pudieran efectuarse los canjes.

Por tanto, y en base a la Orden mencionada anteriormente se acuerda prorrogar el plazo de validez de los permiso británicos por un periodo de dos meses adicional mientras continuan las negociaciones.

Hay que tener en cuenta que esta medida no afecta a los ciudadanos británicos que se desplazan a España durante periodos cortos de tiempo (inferiores a seis meses), los cuales que podrán seguir conduciendo en nuestro país, de acuerdo con lo dispuesto en el artículo 21 del Reglamento General de Conductores, aprobado por el Real Decreto 818/2009, de 8 de mayo.

Es por ello que, los británicos residentes en España que no han podido realizar el canje de su permiso de conducir en el periodo establecido, ven prorrogada el uso de sus licencias británicas, en vigor hasta el 30 de abril de 2022.

Esperemos tener buenas noticias pronto y ver por fin aprobado el Convenio bilateral para facilitar el canje a los británicos afectados por el Brexit.

Renewing a non-lucrative residency (NLV)

We explain everything you need to renew your non-lucrative permit without problems

As we mentioned in our previous post about non lucrative visas, the initial residency is granted for a period of one year after which, if you want to remain in Spain with the same type of permit, you must apply for the renewal. 

CONDITIONS FOR RENEWING A NON-LUCRATIVE PERMIT

While the initial permit is granted for a year period with the renewal this temporary residency will be valid for 2 years.

To be able to renew a non-lucrative residency, the applicant must fulfil all the requirements initially met, for the duration of the new residency term of two years.

Mainly, the requirements are:

  • No criminal records
  • Sufficient economic means
  • Health insurance 
  • Live in Spain continuously 
  • Children of school age enrolled
  • Administrative fees paid

Below you have some considerations for each one of these items:

Renew a non-lucrative residency

SUFFICIENT ECONOMIC MEANS

For the initial residency, the amount requested is 400% IPREM. For the two-year period, the amount will double to 800% IPREM.

If the proof of economic means is done by savings or credits, the amount must cover the whole amount required for the two year period. Whereas, if the proof is provided from pensions, dividend, rent or other regular payments, not originated from a lucrative activity, the requirement is to have a monthly amount of 400%. 

In 2022 the monthly IPREM amount will be 579.02€.

CONTINUOUS RESIDENCE

To be considered continuously residing in Spain, you cannot leave the country for more than 6 months in a year period. 

In case of being out of Spain for more than 6 months, your residency can be revoked and therefore you cannot renew it. 

The annulment is not automatic, and the process starts at the moment the immigration office realizes that the renewal applicant has been out of the country for more than what is allowed. This would prevent the renewal process moving forward. 

HEALTH INSURANCE

As a rule, health insurance is requested for the residency permit, when the applicant is not a beneficiary of the Spanish public health system. 

The main requirement is to have health insurance with similar coverage as the services provided by the National Health System. Commonly, the health insurance will be private, but there are exceptions to this rule.

Ideally, care services including all primary attention, diagnosis, treatment, and rehabilitation activities as well as emergency health transport as part of basic care are preferable considering that those are the services included in the common portfolio of basic care of the SNS. 

CHILDREN OF SCHOOL AGE

If as a resident you have children in your family unit also living in Spain of school age, they must attend school. 

Proof of schooling will be requested at your renewal. 

PAID FEES

Every residency process has a correspondent fee to be paid as a requirement. 

If those fees are not presented with the application, they will be requested by the administration. 

VERY IMPORTANT: After 180 days in Spain, you become a fiscal resident. Compliance with your tax obligations might have an impact on your application in case you are not up to date with it. 

APPLICATION:

The renewal request is addressed to the immigration office from the locality the applicant lives in. 

It can be requested online, in person or in a public register.

The timeline to submit this application is 60 days before the permit expires and 90 days after.

Documents to be presented in the renewal are mainly:

  • EX01 form signed
  • Complete passport
  • TIE 
  • Proof of economic means
  • Health insurance
  • Paid fees

Those documents will vary depending on the personal circumstances of the applicant. E.g.: If they have family members, children, change their home address, etc. 

CHANGING YOUR STATUS 

In the case of not meeting the requirements for the renewal, what can be done?

The immigration act allows you to modify your non-lucrative permit to another type of residency once the initial year is due. 

In case you cannot meet the requirements for renewing but have a job offer or a business plan meeting all the needed requirements, you can request a modification of your status and change your residence authorization to a residency and work authorization.

What to do after receiving a non-lucrative visa? (NLV)

In this previous post we listed some of the characteristics of the NLV and discussed its main requirements such as economic means and health insurance. 

If you are applying for the first time for this residency, this permit is granted for one year and it is renewable twice for two-year terms each time. 

When you apply from abroad and your application is successful, the embassy or consulate issues a visa that will enable you to enter Spain. Normally, this visa is issued for a period of 90 days in which you are expected to enter the country. 

But if the initial permit is granted for 1 year, why is the visa issued only for 90 days?

The non-lucrative visa is a national visa and as such, by general rule, they are issued for a maximum period of 90 days. 

Other national visas can be issued for a longer period because the law established this exception in their specific cases e.g.: Student’s visa can be issued up to 180 days.

How do I get my permit for a year from the 90 days visa? 

Once in Spain, you are expected to apply for a TIE which is an ID card. This card is the final step and once issued, it will display your details, address and the duration of your permit.

How to apply for my TIE?

To apply for your TIE you need to book an appointment online with the office in the locality you are living in to submit the application. 

In the selected date, you must attend in person to the appointment with original and copy of your passport, correspondent signed form (EX-17), paid fees and photos size 26x32mm. 

On some occasions, you will be requested to present your registration in the town hall (empadronamiento) to prove you are living where you stated. We recommend to always look to register prior to the appointment.

What do you need to live in Spain as a freelancer?

If you are considering moving to Spain while working for yourself, in this post you will find the self-employed visa requirements. This authorization will allow you to live and work in Spain as a freelancer.

This permit is granted initially for one year, renewable twice for 2-year periods each time and these are the main requirements:

  • Be a non-EU citizen
  • Not to be forbidden to enter in Spain, be in the country illegally or have committed to not return to Spain, while applying for this visa
  • Have a clear background check
  • Qualify to carry out the work you are planning to
  • Have all the authorizations to open the business in Spain
  • Have enough economic means for the project and for your own maintenance.
Self-employed visa

Business plan, qualification, and investment. 

To apply for a self-employed visa and work as a freelancer, a business project must be set describing the economic activity, business strategy, product, target market, and so on. It must include a financial aspect that specifies the amount of the investment to be made, expected profit and viability of job creation. 

If an opening license is needed or any other sort of authorization or concession, they have to be requested beforehand and by the time the freelancer visa application is submitted, process must be ongoing, or licenses already granted. 

Your professional background and qualifications are expected to meet all standards to develop the business, and therefore it will be subject to evaluation on the application. 

IMPORTANT: If in Spain the activity you are trying to develop requires that you are certified by a professional body, registration or membership must be requested and completed in advance, prior to the business opening.  

The amount of the investment depends on the activity planned. The self-employed visa applicant must present proof of sufficient economic means to cover all the expenses until the business generates enough turnover to sustain itself over time. Personal expenses are expected to be covered as well, at least for the duration of the initial visa.

Business plan feasibility report

All the above-mentioned aspects related to the business can be certified by one of the national self-employed associations such as: ATA, UPTA, CIAE, OPA, UATAE (abbreviations). 

In the case of a viability report being requested from one of these associations, it is issued or rejected on the basis of your business plan, professional profile and sufficiency of economic means presented.  

IMPORTANT: The viability report issued by one of these associations, beneficial for your case but it is NOT binding to the administration!! The Immigration office can interpret differently whether the requirements are met or not. 

The business plan is ready. It’s time to apply

Once you have your business plan straight, you must apply for the visa in a consulate with the following documentation:

  • Visa application form
  • Visa fee
  • Passport 
  • Form EX07 for the residence application
  • The business plan
  • Feasibility report
  • Professional qualification (CV and diplomas)
  • Proof of economic means for the investment and personal maintenance 
  • Criminal records certificate
  • Medical certificate
  • ID card
  • Paid fees from the form 790 052, point 2.1 (temporary residence)
  • Paid fees from the form 790 062, point 1.5 (self-employment authorization)

Depending on the consulate you are applying to, this list can vary slightly. 

If the application is successful, the visa will be issued giving you an estimated time for entry in Spain. 

Once in Spain, within a period of a month, you must register as a self-employed worker in the social security and tax offices. Your residence is only valid after this registration, and you can apply for the TIE in a police station.

When you are freelancing in Spain, you have to pay social security monthly and submit your tax return quarterly. It is important to be up to date with those obligations because renewing this residence will depend on it.

IMPORTANT: The self-employed permit can also be requested from Spain if you are already a resident. E.g.: You have a work employment visa and would like to open your own business and therefore, become a self-employed worker.

Canje del permiso de conducir británico por uno español antes del 31 de diciembre

¡Nuevo procedimiento! ¡Tienes hasta el 31 de diciembre para solicitar tu canje!

¡Te contamos todo para realizar tu canje del permiso de conducir británico sin quebraderos de cabeza!

Hace poco ya publicamos una noticia en la que advertíamos que, aquellos nacionales británicos que quisieran mantener su residencia legal en España después del Brexit, deberán realizar varias gestiones antes de que finalice el periodo transitorio (hasta el 31 de diciembre).

Uno de estos trámites es el canje del permiso de conducir británico por uno español.

Como sabemos, el canje de un permiso de conducir EU es voluntario y se puede conducir en España con total libertad mientras esté el permiso en vigor y siempre que haya sido expedido por un Estado miembro de la UE.

Hasta ahora, así es como se ha actuado con los permisos británicos, pero la DGT ya ha anunciado que aquellos que quieran realizar el canje de sus permisos para la obtención de uno español, deberá hacerlo antes de que termine el año.

La obtención de cita para este en trámite se ha convertido en una verdadera odisea dada la demanda actual para realizar este trámite por parte de ciudadanos británicos. Y por el hecho de que el trámite es presencial.

Pues bien, para agilizar el procedimiento de solicitud canje, sustitución o renovación de permisos británicos y para evitar que después del 31 de diciembre estos permisos pierdan su validez:

La DGT ha establecido que estos permisos sólo serán validos durante los 6 meses posteriores al BREXIT. Pero, el interesado sólo podrá realizar el proceso de canje, renovación o sustitución de este permiso se si inicia el procedimiento antes del 31 de diciembre.

En caso contrario, habrá que esperar a las condiciones establecidas en el caso de firmarse un convenio entre ambos países.

Sabiendo esto, si estas interesado en solicitar un canje de tu permiso británico, debes tener en cuenta lo siguiente:

  • Ser titular de un permiso de conducir expedido en Reino Unido.
  • Tener residencia legal en España.
  • Presentar la solicitud cumplimentada antes del 31 de diciembre de 2020. ¡Puedes descargar el modelo de solicitud aquí!

¡IMPORTANTE!

  • Las solicitudes tramitadas con fecha posterior al 31 de diciembre, ¡NO SERÁN TRAMITADAS!
  • Dentro de este plazo, sólo serán canjeados los permisos que hayan sido verificados por las autoridades de Reino Unido antes del 1 de enero de 2021, teniendo dos posibilidades:

1- Si el permiso es verificado dentro del plazo y cumple con los requisitos:

El interesado tiene un plazo de 6 meses a contar desde el 1 de enero de 2021 para hacerlo efectivo.

Durante este periodo, el permiso británico sigue siendo válido para conducir en España.

De esta forma, el interesado puede realizar el cambio de su permiso de conducir británico por uno equivalente español sin tener que presentarse a las pruebas teóricas y prácticas correspondientes.

2- Si el permiso no es verificado como válido por las autoridades británicas, o no se cumple con alguno de los requisitos:

Se tendrá por finalizado el trámite.

En este caso, el interesado podrá seguí haciendo uso de su permiso británico durante un periodo de seis meses (hasta julio de 2021).

Transcurrido este periodo, los permisos británicos carecerán de validez y los ciudadanos británicos ya NO podrá conducir en España.

Deberán, por tanto, obtener un permiso de conducir español, previa comprobación de los requisitos para ello y habiendo superado las pruebas correspondientes.

Ahora bien, ¿Cómo puedo presentar mi solicitud?

¿Cómo hago el canje de mi permiso de conducir británico por uno español?

A partir del 16 de noviembre, el tramite se realiza en dos pasos:

1- Presentar la solicitud cumplimentada antes del 30 de diciembre de 2020. Lo cual puede hacerse telemáticamete , llamando al 060 o presencialmente en la jefatura de tráfico.

Para agilizar el procedimiento, la DGT ha habilitado en la sede electrónica, el acceso para que los interesados presenten su solicitud.

Recuerda que para acceder a la sede electrónica necesitas contar con Cl@ve, DNI electrónico o certificado digital, así como tener instalado el sistema de Autofirma.

2- Una vez presentada la solicitud, y siendo el permiso verificado como válido por las autoridades británicas, al interesado se le concede una cita para presentar la documentación personalmente en las oficinas de la DGT.

La cita puede concederse desde 3 días hábiles después de presentar la solicitud y durante un plazo de 6 meses.

Si has iniciado el procedimiento telemático, te notificarán la cita.

En caso de no tener respuesta, contacta al 060 para solicitarla.

Documentación que necesitas para realizar el canje de un permiso británico a uno español : CITA PRESENCIAL.

  • Justificante de la cita
  • Formulario cumplimentado
  • Permiso de conducir británico original
  • Permiso de residencia en España original (Certificado UE)
  • Pasaporte original
  • Justificante de haber abonado la tasa (que para el canje es de 28,30 euros).
  • Fotografía 32×26 a color
  • Si vas a realizar una renovación, deberás aportar además un informe de aptitud psicofísica.

Una vez presentada la solicitud, se entregará al interesado un permiso provisional que le permite seguir conduciendo hasta obtener el nuevo permiso español.

Esperamos que esta información haya sido de utilidad y recalcamos la importancia de realizar estos trámites en tiempo y forma para no encontrarnos con problemas futuros.

Por eso, si están en posesión de un permiso británico y resides en España, asegúrate de iniciar el procedimiento del canje para la obtención de uno español antes del 30 de diciembre de 2020.

Pensionistas británicos en España: Preguntas frecuentes

A consecuencia de Brexit, son muchos los cambios a los que se deben enfrentar los ciudadanos británicos que desean permanecer residiendo en España tras finalizar el periodo de transición establecido por el Acuerdo de retirada (hasta el 31 de diciembre de 2020).

Aquellos que deseen mantener sus derechos y privilegios deberán realizar ciertos procedimientos antes de que finalice el 2020:

Algunos ejemplos son la obtención del nuevo documento para ciudadanos británicos que permite a quien lo solicite mantener la condición de residente legal en España en base a lo establecido en el artículo 18.4 de Acuerdo de retirada. Este documento puede solicitarse desde el pasado 6 de julio de 2020.

Otro ejemplo es el canje del carnet de conducir.

A día de hoy, un ciudadano británico puede conducir en nuestro país con su permiso válido y en vigor, expedido por las autoridades británicas. Pero, una vez finalizado el periodo transitorio, a partir del 1 de enero, se aplicará la normativa general sobre los permisos expedidos por terceros estados.

Otra pregunta que nos hacen mucho nuestros lectores es en relación a :

¿Qué ocurrirá con los pensionistas británicos que deseen permanecer en España tras el periodo transitorio?

Respondemos algunas preguntas frecuentes:

¿Se verá afectada la pensión de un ciudadano británico que reside en España? ¿Seguirá percibiendo dicha pensión en las mismas condiciones?

Si. Las pensiones reconocidas antes de que finalice el periodo transitorio (antes del 1 de enero de 2021) seguirá siendo satisfechas de acuerdo con el principio de exportabilidad previos en la normativa europea. Y así o establece el propio Acuerdo de retirada.

Otra cuestión es:

Si un ciudadano británico ha trabajado en España, antes del Brexit y después de esa fecha:

¿Se tendrán en cuenta esos periodo de trabajo para el reconocimiento de una pensión futura en España?

En este caso, se trata de cotizaciones en el sistema de la Seguridad Social española, sin más elemento trasnacional que la nacionalidad británica del trabajador.

Por tanto, este tema no depende de las normas internacionales de coordinación, sino de la legislación española, la cual, no establece ninguna discriminación por razón de nacionalidad a la hora de percibir una pensión contributiva por parte de la Seguridad Social.

Dicho esto, todos los periodos que hayan sido cotizados por un nacional británico en nuestro país, será tenido en cuenta para el reconocimiento de una pensión futura en España.

BREXIT – Changing your driving license in Spain

If you are moving permanently to Spain and wondering what happens with your driving license, here is some information that might be helpful:

As we all know, on December 31st the transition period will come to an end and as of January 1st, the rules that used to be applicable to UK nationals as part of EU will change. (detailed information here)

When it comes to your driving license, until January 21st your British driving licenses are valid. You are not required to do any administrative procedure until then. 

As of January 21st, the applicable law is the one to non-EU countries and according to it, the validity of a driving license is for 6 months from the date of entry into Spain. 

What does it means for UK citizens:

  • If you are already a resident, you should apply to change your driving license for a Spanish one before the end of the transition period. 
  • If you are moving during the transition period, we recommend you to start the procedure as soon as possible, however, you would need to consider your entry date in Spain to know for how long your permit would be valid. 

PROCEDURE:

The interested person or someone on his/her behalf, would need to present the application in person at the DGT (equivalent to the DVLA). 

The appointment can be booked online at the DGT website or by phone (060).

Below is the documentation to start your application:

  • Form  (click here to download)
  • Id document (Passport and EU certificate), after transition period, your new TIE will be required.
  • Proof of residence. Here you can either present a certificate from the city hall (empadronamiento) or authorize the DGT to consult it with regards your address.
  • Driving license
  • Updated photo, size 32×26 cm 
  • Administrative fees of 28.30€ already paid

If you prefer or need to have someone else applying on your behalf, be aware that a specific authorization must be issued. 

Once you apply for your Spanish permit, the DGT will keep your old driving license and issue a provisional one, valid in the whole of Spain, to be used until the permanent one arrives via post to your home address.

Canje de permisos de conducir para ciudadanos británicos

Ayer publicamos un artículo en el que explicamos cómo realizar el proceso de canje de un permiso de conducir expedido por un país europeo a uno español.

Hemos querido reiterarnos en este segundo post haciendo hincapié en el caso de los ciudadanos británico que residen en España.

Como ya sabemos, Reino Unido queda fuera de la comunidad europea y actualmente nos encontramos en un periodo transitorio durante el cual se mantienen los derechos de los ciudadanos conforme al acervo comunitario (Vea más información en este artículo)

Todo esto cambiará a partir del 31 de diciembre de 2020, cuando llegue a su fin el periodo transitorio.

Hasta entonces, la normativa sigue siendo la misma para los ciudadanos británicos que residen en nuestro país. Y por tanto, se sigue aplicando la misma normativa sobre los permisos de conducción, como si de un Estado miembro se tratara.

En consecuencia de esta normativa, a día de hoy, un británico puede conducir por nuestra país con un permiso válido y en vigor expedido por las autoridades británicas.

A partir del 1 de enero de 2021, será de aplicación la normativa general sobre permisos expedido por terceros estados. Es decir, países no comunitarios.

A partir de entonces, los permisos expedidos por Reino Unido habilitarán para conducir en España durante un periodo de seis meses desde la entrada del titular en nuestro país o desde la fecha de obtención de la residencia legal.

Por tanto, con este post queremos recordar que, si eres ciudadano británico y tienes tu residencia legal en España (o tienes pensado residir próximamente), necesitas realiza el canje de tu permiso de conducir antes de que acabe el 2020.

En el caso de españoles que residan actualmente en UK, a partir del 1 de enero de 2021 cambiará también el tratamiento que las autoridades británicas dan a nuestros permisos de conducir.

Por lo que también recomendamos solicitar información para realiza el correspondiente canje de sus permisos españoles.

The Withdrawal Agreement stipulates the terms for The United Kingdom to leave the EU and as expected, it also impacts the principle of free movement granted to every EU citizen. 

As explained previously, it has been decided that British citizens would keep their freedom of movement in the terms of EU law until 31st December 2020, when the transition period is over. It includes, as expected the family members that would re-join the UK citizen in any EU country. 

In order to regulate an administrative process that would make the application of Article 18.4 from the Withdrawal Agreement feasible, the Spanish Government issued a legal instruction on July 4th that describes how to apply for a residency in Spain before Jan 1st 2021 and how to update the old TIE (tarjeta de identidad de extranjeros). 

If you are a family member of a British citizen but you are a national from a non-EU country, these are the steps to obtain/update your residency in Spain:

In EU law, communitarian family members of a certain degree are entitled to re-join the EU citizen to any country he/she decides to live if some minimum requirements are met.  

As mentioned before, the Withdrawal Agreement ensures that this free movement principle will be applicable to UK nationals until the end of the transition period and consequently, the family members rights are also included in this grace period. 

Below you can find all the possible scenarios and steps to follow if you are re-joining a British citizen and you are a family member in any of the following degrees:

  • Spouse
  • Son/daughter under 21 years old or older depending economically on the parents
  • Any family member that depends economically on the UK citizen
  • Any family member that has a severe incapacity and needs to re-join
  • Domestic partner registered or proven

Here are some possible scenarios:

Scenario 1:

Family member already with a legal residence for less than 5 years: 

In this case, the new document would be requested directly at the designated police office, present the following documents:

  • Form EX-23
  • Passport (original and copy of all pages,)
  • Fees payment (Form 790 code 012)
  • Photo

This document would be valid for 5 years and fall under the temporary category. 

In certain cases in which the interested party could demonstrate they have been in Spain for 5 years, a permanent residence could be requested. 

This permit would display the law in which iit s based and therefore it would include “emitido en conformidad con el artículo 18.4 del Acuerdo de Retirada”.

Scenario 2:

UK citizen family member with an expiring temporary Spanish residence card (end of the initial 5 years) 

In this case a two-step process would take place.

First of all, apply for permanent residence at the foreign office. Once granted the status, it would be necessary to have the TIE issued at the police station.

Sept 1: Immigration office

To file the petition, the person interested either must go in person to the immigration office or apply online. 

These are the documents to be presented:

  • Form EX-21
  • Passport (original and copy of all pages)
  • Documents that prove the continuity of the residence in Spain during these 5 years. (It will depend in each case and circumstances)

Once granted the right to the permanent residence, the TIE must be requested.

Step 2: at the police office

Same procedure described in scenario 1 in which the form 23 has to be presented with the mentioned documents to have the TIE issued. Additionally the administrative resolution must be presented as well. 

This TIE will also display the law that regulates it plus with the indication that it is permanent. 

It will be valid for 10 years and after this period it will be automatically renewed. 

Scenario 3:

Non-EU family member already living permanently in Spain. 

In this case, the residence document is already issued with the validity of 10 years and therefore a new TIE displaying the withdrawal agreement and the permanent status would be needed. 

The procedure would be the same in the first scenario and the request is presented by the person interested at the police office. 

Scenario 4:

UK family member, national of a non-EU country without a residence permit in Spain

In this case, also a two steps procedure would be needed. First to apply for the temporary residence and once granted, request the TIE expedition. 

When applying for residency, the applicant can submit the petition personally at the immigration office or online. 

In any case, the documents to follow the petition are:

  • Form EX-21
  • Passport (original and copy of all pages)
  • Document proving the degree of relatedness 
  • Economic means 
  • Health insurance in case that the UK citizen that grants the right to apply to this permit does not work in Spain. (Non-lucrative residences, pensioners, students)

Once the immigration office issue the administrative resolution granting the right to reside legally in Spain, then a TIE would need to be requested. 

As we mentioned before, to request the TIE the interested person needs to attend the police station to file in the application under form 23, passport, paid fees and photo. 

It will a temporary residence, valid for 5 years. Once it is due, it has to be renewed.

As previously announced, on July 4th Spain published the new rules to issue legal residence documentation for UK nationals.

This includes people who would like to move to Spain, are in Spain without a legal residence or are legally living in Spain but would like to update the EU certificate to have a new document issued based on Article 14 of the withdrawal agreement 

All the information about the new document, to whom it applies and scenarios.

Currently we are in a transition period that lasts until December 31st 2020 in which EU law is still applicable and any British national that wishes to live in another country within the EU can do so with the same rights as before Brexit. 

When it comes to Spain, what are the possible situations you would find yourself in and which requirements would you need to meet to apply for your residence document?

British citizens in Spain without legal residence? What to do:

*British citizens without EU certificate (green document)

If you live in Spain but never went to the police station to get your residence certificate issued, these are the circumstances work wise that you would need to prove in order to have your document issued:

  • Currently working in Spain 
  • Self-employed
  • Non lucrative activity with health insurance 

With regards the health insurance, please note that requirements are health coverage in Spain no matter the insurance company or where it is based.

It means that you are not obliged to hire an insurance company in Spain as long you can prove you have full medical coverage in Spain. 

Pensioners will be entitled to Spanish health care if applied for it through a S1 form, issued by the NHS.

In order to successfully process your request and have Spanish health care granted, your application must be submitted to INSS before the end of the transition period (December 31st). 

How do you know your economy status would be considered enough to the government to base your petition on it? 

Every year Spain establishes an economic indicator in the National Budget Act that is taken into consideration when analysing the economic capacity of foreigners in their residence petition.

For this particular case, it would be sufficient to prove your incomes are higher than this indicator. 

If you do not pursue an economic activity in Spain, your economic means will be analysed individually.

Meaning that the bank statements and financial information presented with your application will be considered per dossier.

Nevertheless, your family situation will also be taken into consideration.

  • Students

To be considered a student in Spain you need to be enrolled in a private or public educational institution in Spain. 

When applying for the residence document, proof of enrolment, health insurance and responsible declaration of counting with enough income to maintain yourself during your studies would also be needed. 

Documents to compose your application:

To build up the application dossier, documentation will slightly vary depending on your economic activity as mentioned above. 

For each situation the documents to present with the application would need to prove in which situation you find yourself in. 

For example:

Working contract if you are working as an employee; economic means and health insurance if you are not working in Spain, etc. 

ATTENTION! All documents in foreign language must be translated. 

If they are standard documents from EU countries, neither a translation nor legalization would be required according to a new communitarian rule. 

In all scenarios, these documents will be part of the dossier:

  • Form  EX-20 
  • Copy of passport

How to apply for your residence document based on the Withdrawal agreement?

There are two options available at the moment to apply for the first time for your card

1- Personally at the foreign office from the locality you wish to live. 

In this case you would need to book an appointment beforehand. 

2- Apply online.

In this case you can do it yourself or through a representative. In any case, a digital certificate is needed. 

When is the deadline for applying for this document?

If you have a legal resident status already, there is no deadline to apply for this document.

If you have been away for a certain period of time and come back to Spain after the 1/1/2021, then you would have 3 months to request this document.

Please note it is only applicable if you are already a legal resident in Spain. 

For example, if you are working in Spain previous to the 1/1/2021, have been away and re-enter the country during 2021, then you would have 3 months to apply for this card with all documents that will prove you have been living in Spain before the transition period ends. 

After applying for the card:

Once your application is filed, you would wait for the governments answer in a format of an administrative resolution. This process doesn’t require any administrative fee. 

Once you have this resolution you need to apply for the actual card, only then are administrative fees chargeable. (Form 790 012).

This second procedure takes place in the designated police station and you are required to present it personally. 

How long does it take to get a resolution and the card?

The first procedure in which you present proves that you have been living in Spain, immigration office has a deadline of 3 months to issue a resolution recognizing or not your status of resident. 

Remember if you were not living in Spain but are moving here, what you prove is that you are going to live in Spain in one of the situations described above: Working, self-employed, studying or with enough resources to live without having an economic activity. In the last 2 cases you will also need to present a health insurance policy. 

If after 3 months the government do not reply to your application, it is understood that it has been denied. 

Legal effects of a legal residence based on Article 14 of the Withdrawal Agreement.

This will grant a 5 year period of residence to whomever has the right, recognized by the government. 

If when you apply for this permit you can prove you have been living already for more than 5 years in Spain, the Government will recognize that you are entitled to permanent residence. The duration would be 10 years residence in this case.
